Substantial and Procedural Aspects of Permanent Stay Ancelling

Abstract:

Tématem této práce je zrušení trvalého pobytu občana České republiky podle platného zákona o evidenci obyvatel. Zabývá se vývojem evidence obyvatel na našem území a vznikem trvalého pobytu podle současného znění zákona. Těžištěm práce je zrušení údaje o trvalém pobytu občana ve správním řízení, zejména pak důvody, pro které se tento údaj ruší. Poslední část práce se věnuje novele zákona o evidenci obyvatel. Tato novela byla připravována na konci roku 2012 a měla zabránit zvyšování počtu občanů hlášených k trvalému pobytu na ohlašovnách.

Abstract:

The subject of this work is the cancellation of the permanent residence of the Czech citizen according to the operative law of citizen registry. It deals with the progression of the citizen registry in the Czech Republic territory and the conception of the permanent residence according to contemporary law. The focus of the work is the cancellation of the permanent residence of a Czech citizen in the administrative proceeding, especially the reasons for which this item is cancelled. The last part of the work is concerned with law of citizen registry amendment of act. This amendment of act has been prepared at the end of 2012 and should prevent the increase of the number of citizen registrated to the permanent residence at the registration offices.
