Abstract:

Klubus, M. Zásada subsidiarity trestní represe a zásada procesní oportunity v praxi Policie ČR: bakalářská práce. Brno : MU 2011, 65 s. Vedoucí práce: prof. JUDr. Vladimír Kratochvíl, CSc. Bakalářská práce se zabývá dvěma základními zásadami trestního práva a to hmotněprávní zásadou subsidiarity trestní represe a procesní zásadou oportunity (účelnosti). V úvodní části jsou nejprve vymezeny některé základní pojmy trestního práva, které s tématem souvisí. Hlavní část práce je zaměřena na podstatu a význam uvedených základních zásad, jejich lokaci a vzájemné vazby v rámci sytému základních zásad trestního práva. Dále je pozornost soustředěna na projevy těchto zásad v českém trestním zákonodárství a to jak v kontextu s historickým vývojem trestního práva, tak zejména v rekodifikované platné právní úpravě. Pro srovnání je následně proveden také exkurz do právních úprav vybraných evropských zemí. Uvedené aspekty pak představují východiska pro závěrečné úvahy autora ohledně aplikace těchto právních institutů de lege lata a rovněž návrhy de lege ferenda.

Klubus, M. The Principle of Subsidiarity of the Criminal Represion and Principle of Opportunity in Practise of the Police CR: bachelor thesis. Brno : MU 2011, 65 p. Head of the thesis: prof. JUDr. Vladimír Kratochvíl, CSc. In the first part of bachelor thesis some basic concepts of criminal law related to the topic are defined . The main part is focuses on the nature and significance of the fundamental principles and their location and interactions within the system of fundamental principles of criminal law. Furthermore the thesis deals with the manifestations of these principles in the Czech criminal law, both from a historical perspective, and especially in recodification applicable legislation. For comparison is consequently performed an excursion to the legal regulations in selected European countries. These aspects represent the starting point for final consideration by author about the application of these legal institutions de lege lata and well as suggestions de lege ferenda.
