Ambiguity in the Substantive Delimitation of EU Competences in Relation to Member States, especially in the Light of the ECJ Case-law
Abstract:
Tato diplomová práce pojednává o pravomocech EU ve vztahu k členským státům a poukazuje na jejich nejasné věcné vymezení. Práce vychází ze znění Smluv po ratifikaci Lisabonské smlouvy a z judikatury SDEU týkající se výkladu pravomocí EU. Zabývá se také SDEU jako orgánem řešícím spory o pravomoc mezi EU a členskými státy a možnými alternativními modely kontroly dělby pravomocí.
Abstract:
This master thesis deals with the EU competences in relation to Member States and it points out to the ambiguity in their substantive delimitation. The thesis is based on the text of the Treaties according to the Lisbon Treaty and on the ECJ case-law concerning the interpretation of EU competences.
