Amendment to the Insolvency Act and its Impact on Clients of Debt Counseling Services in Prague

Abstract:

Bakalářská práce Novela insolvenčního zákona a její vliv na klienty služby dluhového poradenství v Praze je zaměřena na změny v insolvenčním zákoně, které přinesla novela tohoto zákona účinná od 1. 6. 2019. Cílem práce je představit podstatné změny tohoto zákona v procesu oddlužení a zhodnotit, jak je vnímají samotní dlužníci. Práce se nejdříve věnuje příčinám vzniku předluženosti a jejich možným řešením. Další část práce se zabývá procesem schvalování novely insolvenčního zákona a zásadním změnám, které novela přináší. Dále je představena služba dluhového poradenství Člověka v tísni a průběh spolupráce s klientem služby, který se připravuje na vstup do oddlužení. Pro dosažení cíle této práce bylo uskutečněno devět rozhovorů s klienty služby dluhového poradenství, kde měl respondent možnost vyjádřit se ke své dluhové situaci a k novele insolvenčního zákona. Z následné analýzy rozhovorů jsou definována silná a slabá místa novely a navržena další opatření.

Abstract:

The bachelor thesis Amendment to the Insolvency Act and its Impact on Clients of Debt Counseling Services in Prague is focused on the Insolvency Act changes brought by the amendment to this act effective from 1 June 2019. The objective of this thesis is to present substantial changes of this act in the process of debt relief and to evaluate how they are perceived by the debtors themselves. The thesis first deals with the causes of over-indebtedness and their possible solutions. The next part of the thesis is about the process of approving the amendment to the Insolvency Act and the substantial changes that the amendment brings. The following section describes a debt relief service of People in need and the process of cooperation with the client. To achieve the goal of this work, nine interviews were lead with clients of the debt counseling service, where the participant had the opportunity to talk about his debt situation and the amendment to the Insolvency Act. Based on the subsequent analysis of the interviews, the strengths and weaknesses of the amendment were identified and further measures were proposed.
