Legal Disposing of Self-governmental Unit Immovable Property

Abstract:

Bakalářská práce na téma „Nakládání s nemovitým majetkem územních samospráv“ je zaměřena na oblast dispozičních úkonů obcí a krajů v České republice s nemovitým majetkem z pohledu platné právní úpravy, doplněné o vybranou judikaturu. Úvodní části práce vymezují základní pojmy, kterými jsou územní samosprávný celek, obec a kraj, jejich charakteristické znaky a postavení, včetně organizačních složek a dalších subjektů majetkoprávní povahy. Následuje průřez pojmy vlastnictví, majetek, způsoby nabývání nemovitého majetku a seznámení s povinnostmi při hospodaření s tímto majetkem. Stěžejní část práce poskytuje podrobný přehled o podstatě a principech nakládání s nemovitým majetkem obcí a krajů, včetně organizačních složek, příspěvkových organizací a obchodních společností s jejich majetkovou účastí. Téma práce rozšiřuje komparace s právní úpravou Slovenska a Polska. Závěr práce vyjadřuje osobní názory autora a návrhy de lege ferenda ve vztahu k platné právní úpravě.

Abstract:

Thesis on the theme “Disposal of immovable property and local self-goverment” is focused on the area of disposition of acts of municipalities and regions in the Czech Republic with the immovable property from the perspective of the applicable legislation, supplemented by selected case law. The initial part of the work of defining the basic concepts, which are regional administrative unit, the municipality and the region, their characteristics and status, including organisational units and other entities of a financial character. The following is a cross section of the concepts of ownership, property, methods of acquisition of immovable property and getting familiar with the responsibilities in the management of these assets. The core (main) part of the work provides a detailed overview of the nature and principles of disposing of immovable property of municipalities and regions, including organizational units, organizations and commercial companies with their ventures. The theme of the work extends the comparation with the legislation of Slovakia and Poland. Conclusion of the work reflects the personal opinions of the author and proposals de lege ferenda, in relation to the valid legislation.
