Interchangeability of Trademarks - Practical Examples
Abstract:
Práce se věnuje tématu zaměnitelnosti ochranných známek. Zaměřuje se na právní rozbor důvodů zaměnitelnosti, a to zejména podle současného známkového zákona a stručně podle nekalosoutěžní úpravy. Popsána jsou kritéria uplatňující se při hodnocení zaměnitelnosti, která jsou následně aplikována při analýze sporů z praxe Úřadu průmyslového vlastnictví a Soudního dvora Evropské unie.
Abstract:
Paper is dedicated to interchangeability of trademarks. It focuses on the legal analysis of reasons leading to interchangeability of trademarks. This analysis is made mainly according to current Act on Trademarks and briefly according to an unfair competition.
