Abstract:

Tématem této bakalářské práce je vkladové řízení před katastrálním úřadem. Katastrální úřad je správní orgán, který má pravomoc rozhodovat o povolení návrhu na vklad věcných práv do katastru nemovitostí. V předkládané práci se čtenář může seznámit s historickými předchůdci současného katastru nemovitostí, jeho předmětem, obsahem a zásadami, kterými se katastr nemovitostí a zápisy vkladů řídí. Jsou zde vyjmenovaná a popsaná věcná práva, jejichž vznik, změna nebo zánik se zapisují, sou to právo vlastnické, právo zástavní, věcná břemena a právo předkupní s účinky práva věcného. Zmíněny jsou všechny formy zápisů věcných práv do katastru nemovitostí. Jsou to vklad, záznam a poznámka.Největší prostor je poskytnutý vkladu a vkladovému řízení, které jako jediná z forem zápisu má konstitutivní účinky. Vkladové řízení má dvě fáze, první lze charakterizovat jako správní řízení, které je zahájeno pouze na návrh účastníků, pokračuje přezkumnou činností katastrálního úřadu a končí správním rozhodnutím, ve kterém katastrální úřad návrh na vklad povolí nebo zamítne. Teprve na základě rozhodnutí o povolení vkladu lze provést zápis do katastru nemovitostí, což je druhá fáze a probíhá jako postupná realizace několika etap v rámci informačního systému katastrálních úřadů.Nejvýznamnějším úkolem katastrálního úřadu v rámci vkladového řízení je přezkumná činnost, která se vztahuje na podaný návrh na vklad a přikládané listiny. Provádí se ke dni podání návrhu na vklad, v tomto okamžiku musí být listina, na jejímž podkladě má k zápisu práv dojít, perfektní. Nedostatky listiny nelze dodatečně zhojit a katastrální úřad svým rozhodnutím návrh na vklad zamítne. Proto je třeba návrhu na vklad i přikládaným listinám věnovat dostatečnou pozornost. Pokud dojde ke změně stavu deklarovaného v listině po podání návrhu, není tato změna pro rozhodování katastrálního úřadu již právně relevantní, to znamená, že na ni není brán zřetel. Hlediska, podle kterých přezkumná činnost probíhá, jsou vymezena zákonem a nelze je překračovat. Katastrální úřad může řízení přerušit nebo zastavit, návrh povolit, částečně povolit nebo zamítnout. U každého z těchto způsobů rozhodnutí katastrálního úřadu o návrhu na vklad nebo řízení, jsou uvedeny opravné prostředky, jež lze proti rozhodnutí použít. V závěru je práce doplněna úvahou o rozporu mezi veřejností katastru, právem na získávání informací z něj a mezi právem na ochranu osobních údajů. Dá se říct, že po několika novelách katastrálního zákona došlo k vyvážení mezi těmito dvěma právy, přičemž v minulosti spíš převažovala možnost nahlížet do katastru bez omezení a bez ohledu na ochranu osobních údajů obsažených v listinách.

Abstract:

Topic of this Bachelor thesis is deposit management in front of a Land Registry office. The Land Registry office is an administrative organ that has got the right to decide on permit of a proposal which is focused on substantive law deposit to a real estate register. Not only can the reader of this work learn about the historical of a current real estate register but also about the subject, content and the principles of which the real estate register and the records of deposit are managed. The substantive laws are listed and described in my work and their emergence, change or abolishment is recorded. These substantive laws are: The law of property, the right of lien, the rights of using and the first option right with effects of the substantive law. All forms of the substantive law records are mentioned in this work. They are the deposit, record and note. The largest area is provided by the deposit and deposit management which as the only one of the forms has got the constitutive effects. Deposit management has got two phases. The first one can be characterised as an administrative action which starts only on the participants´ proposal then it continues with the act of Land Registry examination and this all ends with management decision. This decision is either accepted or refused by the Land Registry office. Then, only on the basis of the decision of the deposit permit it is possible to write into the real estate register. This is the second phase of the deposit management and it goes like gradual realisation of several phases in terms of Land Registry informative system. The most significant Land Registry´s task in terms of deposit management is the act of examination which is somehow connected with the made proposal on a deposit and attached lists. This act of examination must be done on the day when the proposal was made, at this moment the list should be already perfect. The lacks of lists cannot be additionally supplied and the Land Register will refuse the proposal on deposit. Because of that it is important to pay enough attention to both the deposit and the attached lists. If there is a state change in the list after the proposal has been made this change is not relevant anymore and it means that nobody cares about it. Stand-points, according to which the examination act is running, are defined by the law and they cannot be broken. The Land Register may interrupt or stop the management and it may permit or reject the proposal. In every of these means of Land Register decision on a deposit proposal or management, the legal remedies are mentioned and these legal remedies can be used against the decision. At the end of this work, my Bachelor thesis is completed with kind of consideration about a clash between the public register and the right for gaining information from it and between the rights for privacy policy. It can be said, that after several remakes of the register law, there is a balance between these two mentioned rights now, whereas there was a superiority in terms of the possibility to look into the register without any restriction and no matter about the privacy policy included in the lists.
