The Development of the legal Administration of Energetics

Abstract:

Bakalářská práce se věnuje popisu vzniku a vývoje právní úpravy v oblasti energetiky a správy energetiky na území České republiky. Dále se práce zaměřuje platnou úpravu v energetických odvětvích a na správní orgány v oblasti energetiky s akcentem na Energetický regulační úřad, jakožto nezávislý správní orgán dohlížející a regulující oblast energetiky a energetických trhů, Práce začíná úpravou vývoje právní regulace po roce 1918 až do současnosti, kdy po první světové válce docházelo k soustavné elektrizaci a vzniku prvního elektrizačního zákona, který se v průběhu roku vyvíjel a také vzniku dalších zákonných předpisů v oblasti plynárenství a teplárenství. Vývojem času byly tyto zákony nahrazeny a spojeny jednotným zákonem č. 222/1994 Sb., o podmínkách podnikání a o výkonu státní správy v energetických odvětvích a o Státní energetické inspekci. Vlivem zájmu Evropské unie docházelo ke snaze liberalizaci energetických trhů a na tuto skutečnost byla potřeba úpravy legislativy v energetice a vzniku nového energetického zákona (zákon č. 458/2000 Sb., o podmínkách podnikání a o výkonu státní správy v energetických odvětvích a o změně některých zákonů (energetický zákon)), který platí doposud. Práce následně ve své další části rozebírá jednotlivé ustanovení platné úpravy energetického zákona a závěr práce je věnován státní správě v energetice se zaměřením především na Energetický regulační úřad a jeho působnost v jednotlivých letech od jeho vzniku.

Abstract:

This bachelor thesis is devoted to description of the origin and development of legislation of energy management and energy sector in the Czech Republic. The thesis focuses valid regulation in the energy sectors and the administrative authorities of energy, with emphasis on the Energy Regulatory Office, as an independent administrative authority supervising and regulating the energy sector and energy markets Thesis begins modifying legal regulation after 1918 until today, when after the First World War was a systematic electrification and establishment of the first of the electricity bill, which was developed during the year and also the emergence of other legal regulations of gas and heating. Development time these laws were replaced and connected to the uniform Act no. 222/1994 Coll., on business conditions and the performance of state administration in the energy sector and the State Energy Inspectorate. Due to the interest of the European Union were an attempt to liberalize energy markets and this fact was a need for changes in legislation in the energy sector and the emergence of the new Energy Act (Act no. 458/2000 Coll., on business conditions and public administration in the energy sectors and amending certain laws (energy Act)), which is valid until today. Then thesis in their next section discusses the different provisions of current treatment Energy Act and the conclusion is devoted to the state administration in the energy sector, focusing primarily on the Energy Regulatory Office and competence in singles year since inception.
