Material aspect of the administrative offences

Abstract:

Diplomová práce se věnuje institutu materiální stránky správního deliktu. Cílem diplomové práce je jednak vymezit institut materiální stránky správního deliktu, konkrétně jeho obsah, faktory, jež jej ovlivňují a tvoří, význam a roli v právním řádu, jednak potvrdit či vyvrátit hypotézu, že by se správní aplikační orgány měly v rámci odůvodnění správních rozhodnutí zabývat naplněním materiální stránky správního deliktu vždy explicitně. Ze začátku diplomové práce jsou vymezeny základní teoretické základy, zejména pojem správního práva trestního, správního trestání a správního deliktu. Ve druhé kapitole je pojednáno o materiální stránce správního deliktu, konkrétně o okolnostech, které materiální stránku správního deliktu ovlivňují, významu, který materiální stránka správního deliktu představuje, a roli, jež materiální stránka správního deliktu zastává v českém právním řádu. Třetí kapitola diplomové práce pojednává o hodnocení materiální stránky správního deliktu, přičemž uvádí skutečnosti a zjištění, které potvrzují stanovenou hypotézu. Ve čtvrté kapitole je problematika institutu materiální stránky správního deliktu porovnána s pojetím materiální stránky přestupku v právním řádu Spolkové republiky Německo.

Abstract:

This diploma thesis deals with the institute of the material aspect of the administrative offense. The aim of the diploma thesis is to define the institute of the material aspect of the administrative offense, specifically its content, factors that affect and form it, its importance and role in the legal system, and to confirm or refute the hypothesis that administrative authorities should explicitly assess the fulfilment of the material aspect of the adimistrative offense in their decisions. At the beginning of the diploma thesis the basic theoretical rudiments are defined, especially the concept of administrative criminal law, administrative punishing and administrative sanction. The second chapter focuses on the characteristics of the material aspect of the administrative offense, defines the criteria determining the degree of the material aspect of the administrative offense and describes its role in the Czech legal system. The third chapter of the diploma thesis deals with the evaluation of the material side of the administrative offense, while setting out the facts and findings that confirm the established hypothesis. In the last chapter, the material side of the administrative offense was compared with the concept of the material side of the administrative offense in German legal system.
