Current Problems of Copyright Law – Infringements of Copyright Rights at the Internet

Abstract:

Diplomová práce „Aktuální problémy ochrany autorských práv – Porušování autorských práv prostřednictvím sítě Internet“ se zabývá problematikou porušování práv duševního vlastnictví, především u počítačových programů a audiovizuálních děl. V práci jsou nejprve vymezeny základní použité pojmy, a zmíněny důležité mezinárodní smlouvy. Popsána je stručná historie porušování autorských práv u počítačových programů, filmů, hudby a knih. Třetí kapitola práce se věnuje fenoménu warez. Další část se věnuje nástrojům, které umožňují nelegální šíření autorských děl na internetu, jako jsou různé peer to peer sítě nebo zahraniční a tuzemská webová úložiště. Následující kapitola je zaměřena na organizace, které se snaží prosazovat ochranu autorských práv, jako je BSA, RIAA, IFPI a MPAA. Poslední, šestá kapitola práce analyzuje odpovědnost jednotlivých subjektů, které se přímo nebo nepřímo podílejí na šíření nelegálních autorských děl prostřednictvím webových úložišť.

Abstract:

Diploma thesis „Current Problems of Copyright Law – Infringements of Copyright Rights at the Internet“ deals with the issues of intellectual property copyright infringements, particularly in case of computer programs and audiovisual works. The thesis shows the basic terms used, as well as important international treaties. Described is a brief history of copyright infringement in computer software, movies, music and books. The third chapter is devoted to the phenomenon of warez. Next part deals with instruments allowing the illegal distribution of copyrighted works on the Internet, such as various peer to peer networks, or foreign and domestic filehosting services. The following chapter is focused on organizations that are trying to enforce copyright protection, such as BSA, RIAA, IFPI and MPAA. The last, sixth chapter analyzes the responsibilities of particular subjects, which are directly or indirectly involved in the illegal distribution of copyright works through filehosting services.
