Current legislation governing business in Slovakia

Abstract:

The bachelor thesis is mainly focused on current legislation of business in Slovakia. The work is divided into 3 chapters with several subchapters. The first chapter focuses on the theoretical background on the subject entrepreneurship (terminology), which focuses primarily on the concepts of enterprise, entrepeneur, business, regulations governing business and directly affecting business. The content of the second chapter is a comprehensive look at current law entrepreneurship in Slovakia, where our concern is primarily the fundamental law governing civil legal relations, and it is a general law the Civil Code (lex generalis), a special law the Commercial Code (lex specialis), governing trade companies and existing legal standard providing for trade business the Trades Act. The third chapter is devoted other laws related to business such as tax laws, statutory health insurance, social security, assessment of the current business conditions with the accent on legislation on the field of business in Slovakia.

Abstract:

Bakalárska práca sa zaoberá súčasnou právnou úpravou oblasti podnikania na Slovensku. Práca je štruktúrovaná na tri samostatné kapitoly s niekoľkými podkapitolami. Prvá kapitola je zameraná na teoretické východiska k danej problematike (pojmový aparát), kde sa zameriavame predovšetkým na pojmy podnik, podnikanie, podnikateľ, právne predpisy upravujúce podnikanie a bezprostredne sa dotýkajúce podnikania. Obsahom druhej kapitoly je komplexný pohľad na súčasnú právnu úpravu oblasti podnikania na Slovensku, kde predmetom nášho záujmu je predovšetkým základný zákon upravujúci občiansko-právne vzťahy, a to je všeobecný právny predpis Občiansky zákonník (lex generalis), osobitný zákon Obchodný zákonník (lex specialis), upravujúci obchodné spoločnosti a existujúcu právnu normu upravujúcu živnostenské podnikanie, živnostenský zákon. V tretej kapitole sa venujeme ďalším zákonom súvisiacim s podnikaním ako daňové zákony, zákon zdravotného poistenia, sociálneho zabezpečenia, posúdeniu súčasných podnikateľských podmienok s akcentom na právnu úpravu týkajúcu sa oblasti podnikania na Slovensku.
