War Booty

Abstract:

Aim of this diploma thesis is to provide the reader with interpretation and definition of the term of war booty, its evolution and to present legal sources of the issue. The chapters of this diploma thesis are dedicated to theoretical definition of the term of war booty and to historical overview of the significance of the term in ancient, medieval and modern era. It is elaborated about sources of the issue concerning the facts of World Wars with emphasis on Hague Peace Conferences, Hague Conventions and current concept of the term. The diploma thesis contains selected cases of judgments of the issue and the issue of works of arts, culture and science as the war booty is also provided.

Abstract:

Cieľom práce je poskytnúť výklad a definíciu pojmu vojnová korisť, jeho vývoj a predstavenie právnych prameňov o danej problematike. Kapitoly diplomovej práce sú venované teoretickému vymedzeniu pojmu vojnová korisť, historickému prehľadu významu tohto pojmu v období staroveku, stredoveku a novoveku. Rozpracované sú pramene úpravy pojmu v reáliách svetových vojen, dôraz je kladený na Haagske mierové konferencie a dohovory i súčasné poňatie pojmu. V práci sú uvedené vybrané prípady posudzovania vojnovej koristi a spracovaná je aj problematika umeleckých, kultúrnych a vedeckých diel ako vojnovej koristi.
