Real Estates Owned by Municipalities

Abstract:

V bakalářské práci na téma "Nemovitosti ve vlastnictví obcí" se nejprve krátce seznámíme s historickým vývojem samosprávy v českých zemích, pak se současným právním postavením obce, zvláště s oprávněním vlastnit a nakládat s majetkem. Práce obsahuje specifikaci základních pojmů a popis pravomocí jednotlivých obecních orgánů. Největší pozornost je věnována převodům majetku s přihlédnutím k zákonným omezením obcí, vyplývajícím ze zákona o obecním zřízení. Závěrem jsou zmíněny zásady hospodaření s majetkem a jeho kontrola.

Abstract:

The purpose of this thesis is to analyse municipal ownership of real estate. The first part of the thesis provides a brief insight into the historical development of the Czech municipal establishment followed by current legal regulation of municipalities and the right of municipalities to own, dispose of and manage real estate property. The thesis further investigates basic concepts of municipal property ownership and related rights and competences of municipal authorities. The greatest attention is paid to transfer of assets with regard to the statutory restrictions of power of municipalities as a result of the Municipalities Act. The final part of the thesis deals with the principles of municipal management of assets and control of management.
