System of maintenance in Czech republic

Abstract:

Hlavním cílem této práce je analyzovat jednotlivé práva a povinnosti, které se vztahují k výživnému a které jsou rozptýlené v různých českých právních předpisech. Práce přitom používá systémovou metodu, což znamená, že uspořádává tato jednotlivá práva a povinnosti a dosavadní poznatky o nich do jednotného systému. Jako tento systém je identifikován vyživovací závazek. V práci jsou přitom použity oba přístupy dle teorie systémů – systémově-strukturní přístup a funkcionální analýza. Dalším cílem práce je zjistit místo vyživovacího závazku v systému práva. Jsou proto zkoumány všechny nadřazené systémy - právo, soukromé právo a rodinné právo. Následně se práce zabývá přímo vyživovacím závazkem. Práce zkoumá podstatu vyživovacího závazku, jeho účel, historický vývoj, příbuzné instituty a jeho vztah k systému morálky. Je také prozkoumáno jeho vnitřní členění a podmínky jeho vzniku, změn a zániku. Jsou určeny druhy vyživovacího závazku a následně je každý druh analyzován. V práci se podařilo prokázat, že soubor práv a povinností, které se vztahují k vyživovacímu závazku v rámci českého právního řádu a rodinného práva, tvoří jednotný a uspořádaný systém. V práci se podařilo prokázat také to, že všechny druhy vyživovacího závazku mají některé společné rysy, které tvoří jednotu právního institutu vyživovacího závazku. Vyživovací závazek je součástí systémů vyššího řádu, které jej zásadně ovlivňují. Těmito systémy vyššího řádu jsou rodinné právo, soukromé právo a obecně právo jakožto systém nejvyššího řádu. Co se týče nejvyšší úrovně, tedy práva jakožto systému nejvyššího řádu, rámec vyživovacího závazku je konkrétně vytvářen těmi základními lidskými právy, jejichž předmětem je zajištění materiálního zabezpečení jedince a dále těmi, jejichž předmětem je ochrana rodiny. Na vyživovací závazek budou jako na součást soukromého práva aplikovatelné obecné zásady soukromého práva, a dále že na něj bude použitelná obecná úprava závazků. Vyživovací závazek jako součást rodinného práva bude vycházet také z obecné části rodinného práva a zvláštní význam budou mít zásady blaha dítěte, rovnosti subjektů a vzájemné pomoci. Vyživovací závazek je zaopatřovacím závazkem. Účelem institutu vyživovacího závazku je zajistit, aby určitá skupina povinných byla povinna včas poskytovat výživné, které slouží k vyživování, tedy k uspokojení potřeb člověka. Právo na výživu je úzce spojeno se zachováním existence člověka, a proto nejde jen o majetkový poměr, ale i o člověka samotného jakožto mravní a fysiologickou jednotku.

Abstract:

The main purpose of this thesis is to analyze the individual rights and obligations related to maintenance, which are scattered in various Czech legal regulations. The thesis uses a systemic method, which means that it organizes these individual rights and duties and the existing relevant knowledge into a unified system. A maintenance obligation is identified as this system. Both approaches are used in the thesis according to system theory - system-structure approach and functional analysis. Another aim of the thesis is to find the place of the maintenance obligation in the system of law. Therefore, all superior systems - law, private law and family law - are examined. Subsequently, the thesis deals directly with the maintenance obligation. The thesis examines the essence of the maintenance commitment, its purpose, historical development, related institutes and its relation to the system of morality. It also examines its internal structure and the conditions of its formation, changes and termination. The types of maintenance commitment are determined and subsequently each species is analyzed. The thesis has shown that a set of rights and obligations that relate to a maintenance obligation within the Czech legal order and family law form a unified and structured system. The thesis has also demonstrated that all types of maintenance obligation have some common features that form the unified legal obligation of the maintenance obligation. Maintenance obligation is part of higher order systems that have a major impact on it. These higher order systems are family law, private law, and generally law as a system of supreme order. As regards the highest level, namely the law as a system of the highest order, the framework of the maintenance obligation is specifically created by the basic human rights, which aim at securing the material security of the individual and those whose object is the protection of the family. The maintenance obligation will be governed by the general principles of private law as part of private law, and that a general arrangement of obligations will apply. The maintenance obligation as part of family law will also be based on the general family law, and the child's well-being, equality of subjects and mutual solidarity will be of particular importance. The maintenance obligation is a pledge obligation. The purpose of the maintenance obligation institute is to ensure that a certain group of obligors is required to provide maintenance in time to support maintenance, ie to satisfy the needs of a person. The right to maintenance is closely linked to the preservation of the existence of man, and therefore it is not just a property relationship, but also a human being as a moral and physiological entity.
