Offences and Administrative Delicts in International Trade with Foreign Countries

Abstract:

Anotace HLAVÁČEK P. Přestupky a správní delikty při obchodování se zahraničím. Bakalářská práce Brno, Masarykova univerzita, 2016. Cílem bakalářské práce je poukázat na nejčastější přestupky a celní delikty, ke kterým dochází při obchodování subjektů se zahraničím. V úvodu popisuji zařazení Celní správy ČR do systému správních orgánů. V další části se zaměřuji na činnost Celní správy ČR a následná část pojednává o celním řízení. Tady jsem poukázal na celní přestupky fyzických osob a správní delikty právnických osob a demonstroval jsem je na konkrétních příkladech z mé praxe celníka a celního deklaranta. V poslední části se zabývám obchodem mezi členskými zeměmi Evropské unie a povinnostmi subjektů, které jim vyplývají z tohoto obchodu. Zmiňuji se i o Intrastatu, jako základní povinnosti zpravodajských jednotek vykazovat obchod v rámci EU na základě statistických výkazů. Na závěr jsem si dovolil nastínit několik svých připomínek a nápadů, jak by bylo možné snížit rizika celních i daňových úniků, které vycházejí z mé dlouholeté praxe v oboru.

Annotation HLAVÁČEK P. Offences and Administrative Delicts in International Trade with Foreign Countries. Bachelor thesis. Brno, Masaryk University, 2016. The aim of this Bachelor thesis is to analyze the most frequent offences and customs delicts in international trade. As an introduction I define the position of the Customs Administration within the administrative organs of the Czech Republic. Next, I characterize the function of Customs Administration of the Czech Republic and the Customs Procedure. In this part I demonstrate the offences of natural persons and administrative delicts of legal persons and also provide examples of these frauds from my own experience as a customs officer and customs agent. In the last chapter I describe the trade with goods between the Member States of European Union and related duties of trade operators. Especially I focus on Intrastat, a system for collecting statistical data on the trade, which is the major obligation arising from undertaking activities of exchange of goods with other EU Member States. Finally, I dare to present several remarks and suggestions how to decrease the risks of customs and tax avoidance, which stem from my expertise in the field.
