Abstract:
Tato práce se zabývá uplatněním „testu stejně efektivního soutěžitele“ při posuzování zneužití dominantního postavení jednáním vylučujícím ostatní soutěžitele. Použití tohoto testu upravuje sdělení Evropské komise z roku 2009, které zavádí více ekonomický přístup k prosazování čl. 102 Smlouvy o fungování EU. Abstract:
This thesis deals with the application of the „as-efficient competitor test“ in assessing the abuse of a dominant position in the form of an exclusionary conduct. The application of the test is recommended in the European Commission Communication from 2009, which introduces more economic approach to the enforcement of the article 102 of the Treaty on the functioning of the European Union.
