The nature of the right to complete a blank bill of exchange and its influence over the position of the blank bill of Exchange debtor

Abstract:

Předkládaná práce se zabývá vlivem směnečného vyplňovacího práva na postavení dlužníka z blankosměnky. Toto je zkoumáno z pohledu české doktríny směnečného práva a rozhodovací praxe českých soudu a z pohledu polské doktríny směnečného práva a rozhodovací praxe polských soudů. Cílem diplomové práce je analyzovat jaký vliv na dlužníka z blankosměnky směnečné vyplňovací právo má. Jaké námitky má dlužník k dispozici, za jakých podmínek je oprávněn je vznášet a vůči kterým dlužníkům se takto může úspěšně bránit.

Abstract:

The thesis studies the influence of the right to complete a blank bill of exchange on the position of a debtor of a blank bill of exchange. This is investigated from the view of the Czech law doctrine of bills of exchan-ge and the Czech courts decision-making practice and from the view of the Polish law doctrine of bills of exchange and the Polish courts decisi-on-making practice. The aim of the thesis is to analyse what influence the right to complete a blank bill of exchange has on the debtor of a blank bill of exchange and further, what objections are available to the debtor, under what conditions is he entitled to raise them and against which debtors can he thence protect himself successfully.
