Stalking

Abstract:

Nebezpečné pronásledování se stalo moderním fenoménem nejen ve světě, ale i v naší republice. Bakalářská práce pojednává o stalkingu, v první části zejména o obecných definicích a v rámci zavádění tohoto trestného činu v různých zemích Evropy přibližuje a porovnává antistalkingovou úpravu Německa a Rakouska. Další část práce je zaměřená na psychologii pachatelů, typologii a možnosti pomocí obětem trestných činů. Pro správné posouzení rizikovosti pachatele a vhodná ochranná opatření pro oběti je nutné si sestavit psychologický profil pachatele. Vzhledem k masivnímu rozvoji IT technologií je k seznámení krátce popsána zvláštní podoba stalkingu – cyberstalking. Právní úpravě, popsání skutkové podstaty trestného činu a trestům je věnována třetí část práce. Pro ilustraci nebezpečnosti některých jednání jsou přidány i jedny z nejznámějších případů stalkingu v ČR. Praktická část je věnována možnostem policisty při kontaktu s obětí, možnostem ochrany oběti a trestnímu řízení. Do poslední části jsou zařazeny statistické výsledky z České republiky po zavedení nebezpečného pronásledování mezi skutkové podstaty trestného činu s účinností od 1. 1. 2010. Tyto výsledky vycházejí ze statistik vedených Policií ČR.

Abstract:

Stalking or dangerous pursuits has become a modern pfenomen, not only in the world but in our country. The thesis deals with stalking, especially in the first part with general definitions and introduction of this crime in different countries in Europe introduces and compares /antistalking/ treatment of Germany and Austria. Additional part is focused on the psychology of offenders, their typology and the opportunity to assist to the victims of crime. For the proper risk assessment of offenders and appropriate protective measures for victims, it is necessary to compile a psychological profile of the offender. Due to the massive development of IT technology there is a short introduction that briefly describes the specific form of stalking - cyberstalking. The third part of the work presents legislation, describing the crime and punishment To illustrate the danger of some behaviour there are described some of the most famous cases of stalking in our country. The practical part is devoted to police officers in contact with the victim, the possibilities of protection of victims and prosecution. The last part includes the statistical results of the Czech Republic after the introduction of malicious persecution of the crime, with effect from the 1st of January 2010. These results are based on statistics registered by the Police.
