Constitutional Aspects of Presidential Transition in the United States of America

Abstract:

Tato diplomová práce se věnuje problematice předání moci ve Spojených státech amerických. Přibližně dva a půl měsíce trvající období mezi prezidentskými volbami a inaugurací, známé jako Presidential Transition, je možné vnímat jako období nejistoty, nestability a určitých paradoxů. Na straně jedné je zde odcházející americky prezident, který až do inauguračního dne nerušeně vykonává svůj úřad. Na straně druhé se nová administrativa připravuje na uchopení moci, ohlašuje nominace na funkce v exekutivě a připravuje legislativní návrhy tak, aby novy amerických prezident mohl začít vykonávat svůj úřad bezprostředně po složení přísahy. V posledních desetiletích se ve Spojených státech vyvíjí podobor ústavního práva, jenž taktéž zasahuje do práva správního a práva volebních kampaní, který se nazývá Law of Presidential Transitions. Uvedená diplomová práce čtenářům v celkem pěti kapitolách představuje dosud po právní stránce v českém prostředí nepopsaný fenomén předání moci ve Spojených státech amerických, který má své právní, ale i mimoprávní aspekty. Předmětná problematika je nejprve nastíněna ve světle svých ideových, historických a teoretických východisek. Tato práce interpretuje kromě souvisejících ustanovení Ústavy Spojených států amerických také federální právní úpravu, která po organizační a institucionální stránce upravuje tuto komplexní problematiku. Celý proces je následně představen v kontextu prezidentských voleb a procesů souvisejících s hlasováním Sboru volitelů. V neposlední řadě práce taktéž představuje ryze praktickou stránku předání moci, která je dána do souvislosti s prezidentskou volbou roku 2020 a předáním moci mezi Donaldem Trumpem a Joe Bidenem.

Abstract:

This diploma thesis deals with the issue of power transition in the United States of America. The two-and-a-half-month period between the elections and the inauguration, known as the Presidential Transition, can be seen as a time of uncertainty, instability, and certain paradoxes. On the one hand, the outgoing American president is in office until the inauguration day. On the other hand, the new administration is preparing to seize power, announcing nominations for executive positions, and also preparing legislative proposals so that the new American president can take office immediately after taking the oath. In recent decades a new sub-field of constitutional law has been developed in the United States of America. This sub-field called the Law of Presidential Transitions also interferes with administrative law and political campaign law. In five chapters, this diploma thesis introduces the topic of the transition of power, which has not yet been described from both legal and non-legal points of view to the Czech audience. The subject matter is first outlined regarding its ideological, historical, and theoretical background. In addition to the related provisions of the Constitution of the United States of America, this thesis also interprets the federal laws and regulations concerning this complex issue. The entire process is then presented in the context of the presidential election and the procedures related to the meeting of the Electoral College. Last but not least, the work also presents a purely practical aspect of the transfer of power, which is linked to the Presidential elections of 2020 and the transfer of power between presidents Donald Trump and Joe Biden.
