Consistency of Czech public procurement legislation with the Community law

Abstract:

Práce rozebírá legislativu v oblasti veřejných zakázek jak v České republice, tak i legislativu v rámci Evropské unie. Soustřeďuje se na nové právní úpravy v důsledku přistoupení České republiky mezi členy Evropské unie. V práci jsou uvedeny právní předpisy Evropské unie, které byly transponovány do legislativy České republiky a které byla Česká republika povinna přijmout. Předmětem práce je také samotné zadávání veřejných zakázek a postup proti nesprávnému postupu zadavatele. Analytická část práce se věnuje analýze aktuálního stavu zadávání veřejných zakázek u vybraného veřejného zadavatele. Závěrem jsou nastíněny také připravované změny právních úprav EU a ČR.

Abstract:

This bachelor thesis analyzes the legislation in the area of public procurement in both the Czech and the legislation within the European Union. It focuses on the new legislation as a result of the accession of the Czech Republic among the members of the European Union. In the thesis are presented the legislations of the European Union, which have been transposed into legislation of the Czech Republic and the Czech Republic was obliged to accept. The subject of the thesis is also the procurement and procedure against any improper procedure of the contracting authority. The analytical part of the thesis is devoted to the analysis of the current state for the selected procurement the contracting authority. The conclusion outlines upcoming changes to the legislation also the EU and the Czech Republic.
