Seizure operations in criminal proceedings

Abstract:

Bakalářská práce se zaměřuje na trestní řízení a zahrnuje analýzu procesních úkonů zaměřených na zajištění osob. V teoretické části jsou prozkoumány základní aspekty zajišťovacích úkonů včetně jejich dopadu na omezení lidských práv, absolutní práva a význam klíčových zásad. Práce rovněž definuje základní pojmy související s trestním řízením, jako jsou účastníci procesu (podezřelý, obviněný, obžalovaný, odsouzený, obhájce a svědek) a charakteristiky trestného činu. Práce také přináší přehled institucí, které se zabývají zajišťovacími úkony. Dále jsou zkoumány specifické procesní úkony v České republice, jako jsou předvolání, předvedení, příkaz k zatčení, mezinárodní zatykač, evropský zatýkací rozkaz, zadržení a vazba. Detailně jsou rozebrány důvody vazby, možnosti stížností proti usnesení o vzetí do vazby, délka trvání vazby a možnosti nahrazení. Právní rámec zajišťovacích úkonů je posuzován jak z hlediska české ústavy, tak i ve srovnání s právní úpravou na Slovensku. Výsledky práce poskytují ucelený pohled na teoretické a praktické aspekty zajišťovacích úkonů a jejich vliv na trestní řízení.

Abstract:

The bachelor thesis focuses on criminal proceedings and includes an analysis of procedural acts aimed at the detention of persons. The theoretical part examines the basic aspects of detention, including their impact on the limitation of human rights, absolute rights and the importance of key principles. The thesis also defines basic concepts related to criminal proceedings, such as the parties to the proceedings (suspect, accused, convicted, defence counsel and witness) and the characteristics of the offence. The work also provides an overview of the institutions involved in seizure proceedings. Furthermore, specific procedural acts in the Czech Republic, such as summons, production, arrest warrant, international arrest warrant, European Arrest Warrant, detention and custody are examined. The grounds for detention, the possibilities of appealing against a detention order, the duration of detention and the possibilities of its replacement are discussed in detail. The legal framework of detention is examined both in terms of the Czech Constitution and in comparison with the legislation in Slovakia. The results of the work provide a comprehensive view of the theoretical and practical aspects of detention orders and their impact on criminal proceedings.
