Regulation of Lobbying in the EU Institutions: The Reflection of the Commission’s and Parlament’s Scheme in the Joint Regulatory Mechanism

Abstract:

Tato práce zkoumá, jak je lobbing regulován v institucích EU, respektive v Evropské komisi a Evropském parlamentu. Důraz je kladen na opatření zahrnující lobbisty i lobbované veřejné činitele. Interinstitucionální postup byl uplatněn z hlediska regulace lobbistů, nikoli však z hlediska poslanců a komisařů. Zde obě instituce uplatňují vlastní standardy, přestože v řadě prvků jsou regulace shodné. Co se týče regulace lobbistů, ve společném regulačním mechanismu založeném na interinstitucionální dohodě se promítla obě původní schémata EK a EP, přesto lze jako dominantní označit s ohledem na řadu uplatněných aspektů právě schéma EK.

Abstract:

This dissertation focuses on the lobbying regulation in the EU institutions, i.e. the European Commission and the European Parliament. The attention is paid on regulation of lobbyists and lobbied public officials. An interinstitutional approach has been applied regarding the rules for lobbyists. However, the rules for members of the European Parliament and European Commission have not been merged yet and both institutions continue with their own standards despite the fact that the regulations covering parliamentarians and commissioners are in many aspects incidental. As far as the regulation of lobbyists is concerned, the common mechanism based on interinstitutional agreement reflects both original schemes of the Commission and the Parliament. Nevertheless, the prevalent of the two is in many aspects the scheme of the Commission.
