Wiretapping and record of telecommunication traffic

Abstract:

Tato bakalářská práce se zabývá problematikou institutu odposlechu a záznamu telekomunikačního provozu a institutu zjišťování údajů o telekomunikačním provozu, který představuje důležitou funkci v odhalování především organizované trestné činnosti. Práce je rozdělena na teoretickou a praktickou část. První část je zaměřena na právní vývoj institutu odposlechu a záznamu telekomunikačního provozu a institutu zjišťování údajů o telekomunikačním provozu na našem území a na vymezení základních pojmů, které s danou problematikou souvisí. Následně práce analyzuje právní úpravu obou institutů a hodnotí, zda je jejich právní rámec v trestním řádu dostatečně vymezen. Dále se práce zaměřuje na porovnání právní úpravy na našem území a v zahraničí. Součástí práce je i vztah Evropské Unie k oběma institutům. Obsahem práce jsou náměty De lege ferenda.

Abstract:

This bachelor thesis deals with the issue of the institute of wiretapping and recording of telecommunication operations and the institute of collecting data on telecommunication operations, which represents an important function in the detection of mainly organized crime. The thesis is divided into two parts – the theoretical and the practical part. The first part is focused on the legal development of the institute of interception and recording of telecommunication operations and the institute of collecting data on telecommunication operation in our territory and the definition of basic concepts related to the issue. Subsequently, the thesis analyses the legal regulations of both institutes and evaluates whether their legal framework has determined them in the Criminal Procedure Code. Furthermore, the thesis focuses on the comparison of legislation in our territory and abroad. Part of the thesis is the relationship of the European Union to both institutes. The content of the work, are based on De lege ferenda
