Removal of buildings under the Building Act

Abstract:

Tato práce měla za cíl přiblížit řízení o odstranění stavby. Dotknula se témat vzniku stavby, resp. vzniku práva staveb. Krátkou exkurzí se snažila postihnout významná období v souvislosti se změnami stavebních řádů. Snažila se vyložit pojem "stavba". Práce též přiblížila dotčené správní úřady stavební odbory, od obecných po ty speciální. Popsala správní postupy při povolování staveb, to vše tak, aby následně uvedla řízení o odstraňování staveb, a jejich případnému dodatečnému povolení jako součásti tohoto řízení. Rozvedla některá řízení o odstranění stavby, od těch obvyklých po ty neobvyklé. Zmínila některé možné problémy správních orgánů stavebních úřadů při prosazování svých rozhodnutí, vymahatelnosti, ale i stránku nákladů takových to rozhodnutí.

Abstract:

This work was aimed at bringing closer the procedure for the removal of the building. She touched the themes of the construction, respectively. the right of construction. A short excursion attempted to cover significant periods in the context of changes in building regulations. She tried to interpret the term "building". The work was also brought to the attention of the administrative authorities concerned - construction departments, from general to special ones. It describes the administrative procedures for the permitting of buildings, all in order to subsequently state the procedure for the removal of buildings and their possible additional authorization as part of this procedure. She has divorced some procedures for building removal, from the usual to the unusual. It mentioned some possible problems of the administrative authorities - the building authorities in enforcing their decisions, enforceability, but also the cost side of such decisions.
