General principles and regular criteria to be considered when imposing sentence of imprisonment

Abstract:

This thesis deals with the general principles and regular criteria to be considered when imposing an unconditional sentence of imprisonment for adult offenders in terms of a legal obligation. The introductory part of the thesis is left to a theoretical introduction to the issue with the exposition of the concepts of personal freedom, social harm and the principles of subsidiarity of criminal repression. For a comprehensive understanding of the issue, the purpose and position of the unconditional sentence of imprisonment as one of the basic factors in its imposition are also pointed out. The thesis then presents the formal requirements of the decision imposing the unconditional sentence of imprisonment and the importance of its justification. The core of the thesis is a practical analysis of selected judgments of courts of the Czech Republic in order to examine the consideration of the general principles and regular criteria when imposing the unconditional sentence of imprisonment. The differences between the legal regulation of the Czech Republic and the Slovak republic are also included. Finally, the thesis describes the general findings of the analysis and also presents de lege ferenda considerations, which could lead to the elimination of the identified shortcomings, either in the legislation or the practical judicial sphere.

Abstract:

Rigorózna práca sa venuje všeobecným zásadám a pravidelným kritériám, ktoré majú byť v zmysle zákonnej povinnosti zohľadňované pri ukladaní nepodmienečného trestu odňatia slobody dospelým páchateľom. Úvodná časť práce je ponechaná teoretickému úvodu rozoberanej problematiky s predstavením pojmov osobnej slobody, spoločenskej škodlivosti a zásady subsidiarity trestnej represie. Pre ucelené pochopenie problematiky je poukázané aj na účel a postavenie nepodmienečného trestu odňatia slobody, ktoré sú jednými zo základných pôsobiteľov pri jeho ukladaní. Práca následne prezentuje formálne náležitosti rozhodnutia, ktorým sa nepodmienečný trest odňatia slobody ukladá a dôležitosť jeho odôvodnenia. Jadro rigoróznej práce predstavuje praktická analýza vybraných rozsudkov všeobecných súdov Českej republiky s cieľom skúmania zohľadňovania zákonom stanovených všeobecných zásad a pravidelných kritérií pri ukladaní nepodmienečného trestu odňatia slobody. Poukázané je aj na rozdielnosť zákonnej úpravy Českej republiky a Slovenskej republiky. Záverom sú v rigoróznej práci popísané všeobecné zistenia vykonanej analýzy a taktiež sú predstavené úvahy de lege ferenda, ktoré by mohli viesť k odstráneniu zistených nedostatkov či už v zákonnej úprave alebo v praktickej justičnej sfére.
