Reasoning by Analogy
Abstract:
Tato diplomová práce se zabývá argumentem per analogiam z pohledu logického a teleologického. Práce se věnuje samotnému pojmu analogie a jejím druhům, které jsou ukázány na příkladech z praxe českých soudů. Následně je zkoumána struktura argumentu, jeho povaha a podmínky aplikace. Následně je proveden formální zápis. V závěru je analogie porovnána s jiným právními argumenty.
Abstract:
This thesis deals with reasoning by analogy and it does so from logical and teleological point of view. Thesis pursue meaning of the word “analogy” itself and its kinds, which are shown on examples from Czech judicial practise. Afterwards a structure of analogy is examined, its nature and conditions of application. Then analogy is formalized to logical formula. In the end analogy is compared with other …more
