An Agreement on Guilt and Punishment

Abstract:

Tématem této diplomové práce je Dohoda o vině a trestu. V teoretické části diplomové práce se v první kapitole věnuji nejprve základním teoretickým pojmům. V první části jsem se zaměřila na pojem „odklon“ obecně a zmínila jsem názory vybraných autorů. Druhá kapitola této diplomové práce pojednává zprvu obecně o odklonech a dále se věnuje vybraným zvláštním způsobům trestního řízení a to podmíněnému zastavení trestního stíhání a institut narovnání. Třetí kapitola je zaměřena na stěžejní téma diplomové práce a tím je institut dohody o vině a trestu. Nejprve se zabývám zakotvením institutu do české právní úpravy, dále jsem se věnovala slovenské právní úpravě. V praktické části práce jsem zaměřila na cíl práce a tím je, užití institut dohody o vině a trestu v současné praxi. Věnovala jsem se rozboru dotazníkového šetření a vytvořila grafické znázornění. Na závěr jsem shrnula splnění cíle výzkumu.

Abstract:

The topic of this thesis is the Agreement on Guilt and Punishment. In the theoretical part of the thesis, the first chapter is devoted to the basic theoretical concepts. In the first part I focused on the concept of "diversion" in general and I mentioned the opinions of selected authors. The second chapter of this thesis deals initially with diversions and then deals with selected special methods of criminal proceedings, namely conditional cessation of prosecution and the institute of settlement. The third chapter focuses on the main topic of the thesis, which is the institute of agreement on guilt and punishment. First I deal with the establishment of the institute in the Czech legislation, then I focused on the Slovak legislation. In the practical part I focused on the aim of the work and that is to use the institute of agreement on guilt and punishment in current practice. I focused on the analysis of the questionnaire survey and created a graphical representation. Finally, I summarized the fulfillment of the research objective.
