Abstract:

Ve své diplomové práci se věnuji problematice obecně závazných vyhlášek obcí vydávaných v samostatné působnosti. Na začátku zmíním některé základní pojmy týkající se veřejné správy. Rovněž je malá část práce věnována historii právních předpisů samosprávy na našem území, abych přiblížila jejich vývoj. V další části se zaměřím na obecné vymezení obecně závazných vyhlášek a jejich postavení v systému právních předpisů podle čl. 104 odst. 3 Ústavy České republiky, podle které jsou vydávány. Dále zmíním, jak jsou vyhlašovány, schvalovány, jaké jsou jejich náležitosti, kdy nastává jejich platnost a účinnost a samozřejmě i to, jaké mohou být sankce za jejich porušení. Nemohu opomenout ani dozor nad obecně závaznými vyhláškami vykonávaný Ministerstvem vnitra. V další části práce se věnuji jednotlivým oblastem, které mohou být regulovány prostřednictvím obecně závazných vyhlášek, a to i s ohledem na judikaturu Ústavního soudu.

Abstract:

In my dissertation I apply to the issue of generally obligatory municipality regulations, published in self-governing scope of activity. In the beginning I mention some basic terms related to the public administration. I also dedicate a part of my work to the history of legal regulations of a home rule in our territory to give an idea of their development. In the subsequent part I concentrate on general qualification of those regulations and their position in a rule system in accordance to article r.104 para 3 of the Czech Republic Constitution issued according to the Constitution. I mention further how they are proclaimed, approved, their requirements, when their legal force and effect begins and of course, also potential sanctions for their violation. I can not even omit an oversight of these regulations performed by the Ministry of the Interior. The next part of my work is dedicate to the particular spheres that can be regulated via generally Obligatory municipality regulations, considering the related judicature of the Constitutional court.
