Legal and Economic Aspects of the Implementation of the Building Right

Abstract:

Práce pojednává o právních a ekonomických aspektech práva stavby, a to jak z teoretického hlediska, zejména z pohledu jeho zakotvení v českém právním řádu, tak z hlediska praktického, kdy jsou představeny možnosti využití práva stavby, evidence práva stavby v katastru nemovitostí nebo náklady spojené se zřízením či převodem práva stavby. Práce obsahuje podrobný rozbor právní úpravy práva stavby doplněný o možnosti, které občanský zákoník přináší jak vlastníkovi zatíženého pozemku, tak stavebníkovi, při uzavírání smlouvy o zřízení práva stavby. Uvedeny jsou praktické příklady využití práva stavby v soukromé i veřejné sféře. Poukázáno je i na negativní ekonomické aspekty práva stavby s doporučeními pro minimalizaci jejich dopadů.

Abstract:

The thesis deals with the legal and economic aspects of the right to build, both from a theoretical and practical point of view. The theoretical part provides information about the inclusion of the right to build in the Czech legal order and comments on its characteristics. The practical part presents the possibilities of use of the right to build, costs regarding the creation, transfer and termination of the right to build, its registration in the Cadastre of Real Estate. The thesis contains a detailed analysis of the regulation of the right to build with possibilities, which the Civil Code offers to the developer and to the owner of the encumbered land when concluding the treaty establishing the right to build. Practical ex-amples of the use of right to build are included. The thesis mentions also the negative eco-nomic aspects of the right to build with recommendations to minimize their impact.
