Bill as a Tool to Secure an Obligation

Abstract:

Tématem mé bakalářské práce je směnka jako nástroj zajištění závazku. Práce se zabývá stručnou charakteristikou směnky coby druhu cenného papíru. V úvodu popisuji obecnou historii směnek. V další kapitole uvádím základní druhy směnky, její podstatné náležitosti a funkce a v neposlední řadě představím jednotlivé účastníky směnečně právních vztahů a s tím související práva a povinnosti. V mé práci se budu hodně odkazovat na hlavní pramen práva určený pro problematiku směnečného práva, tj. Zákon směnečný a šekový – č. 191/1950 Sb. Dále se budu odkazovat i na nový občanský zákoník, zákon č. 591/1992 Sb., o cenných papírech, ve znění pozdějších předpisů, judikaturu a různé komentáře. Práci jsem obohatil také o vybrané vzory směnek, včetně popisků jednotlivých účastníků a směnečných operací.

Abstract:

The topic of my thesis is the ,,Bill as a Tool to Secure an Obligation“. The work deals with brief description of the bill as the type of security. The introduction describes the general history the bill of exchanges. In the next chapter I mention basic kinds of bills, essential requirements and functions. Then I will desribe individual participants of bills of legal relations and their rights and obligations. In my work i much refer to the main source of law, i.e. Code no. 191/1950 Coll., by the new Civil Code, No. 89/2012 Coll., Code No. 591/1992 Coll Securities Act, case law and commentary. At the end of the text are a selected patterns bills and descriptions participants and promissory note operations..
