Analysis of Article 1 of CISG - Practical Impacts

Abstract:

Tématem této bakalářská práce je "Analýzu článku 1 Úmluvy OSN o smlouvách o mezinárodní koupi zboží" (Úmluva). Článek 1 upravuje možnost použití Úmluvy v kupních smlouvách s mezinárodním prvkem. Úvodní část práce pojednává o aplikačních předpokladech, legislativní historii článku 1 a vymezení mezinárodního prvku. Stěžejní část práce je věnována analýze článku 1 odst. 1 písm. a) Úmluvy formou přímé aplikace, analýze článku 1 odst. 1 písm. b) jako součást rozhodného práva a výhradě dle článku 95 Úmluvy. Analýza je podložena příklady z judikatury obecných a rozhodčích soudů.

Abstract:

The topic of this thesis is "the analysis of article 1 of the United Nations Convention on Contracts for the International Sale of Goods" (CISG). Art. 1 CISG provides for possibility of application of the Convention in a sales contract with an international element. The introductory part of the work deals with the application prerequisites, the legislative history of article 1 and the definition of the international element. The main part of this thesis is devoted to the analysis of art. 1(1)(a) CISG as a direct application, the analysis of art. 1(1)(b) CISG as a part of the applicable law and reservation under art. 95 CISG. The analysis is based on examples from the case-law of the general and arbitration courts.
