Ethical Codes in the Public Administration

Abstract:

Bakalářská práce se zabývá etickými kodexy ve veřejné správě, které mohou zlepšit její výkon, zefektivnit ji a také zvýšit její transparentnost. Práce zpracovává etické kodexy krajských měst v České republice. Zaměřuje se zejména na vymahatelnost kodexů a na následné postihy za jejich nedodržení. Zákonem není stanoveno, zda musejí mít obce vlastní etický kodex, proto bylo zpracováno pouze 7 etických kodexů krajských měst, která ho mají. Klíčovým rokem v oblasti etiky ve veřejné správě byl rok 2012, kdy ministerstvo vnitra vydalo Etický kodex úředníků a zaměstnanců veřejné správy. Města a obce mohou tento kodex využít, nebo vydat vlastní. Stěžejní oblastí je právě vymahatelnost kodexů a následné sankce za jejich porušení. Hlavní otázkou tedy je, zda dojde pouze k morálnímu odsouzení jedince, či lze tento kodex vymáhat a jedince tvrdě potrestat, například propuštěním z úřadu.

Abstract:

The bachelor thesis focuses to Ethical Codes in public administration that can improve its performance, make it more effective and increase its transparency. The work elaborates Ethical Codes of regional cities in the Czech Republic. The work particularly aims at the enforceability of the codes and the subsequent penalisation for non-compliance. The law does not specify whether the municipalities must have Ethical codes, therefore only 7 Ethical Codes have been utilized as only 7 of 13 regional cities have their own. The key year for the area of Ethics in the Public administration was 2012, when the Ministry of the Interior, published the Code of Ethics of Civil Servants and Employees of Public Administration. Municipalities and regional cities can use this Code of Ethics, or they can publish their own. The key area is the enforceability of these Ethical Codes and subsequent punishment for non-compliance. The main question therefore is whether the individual will be only morally condemned or whether the Codes can be enforced, and the individual will face more severe punishment, such as dismissal from the office.
