Abstract:

Cílem této práce je představit čtenáři téma zdravotní péče ve Spojených státech amerických, snahy o ustanovení univerzálního zdravotnického systému na federální úrovni a zároveň analyzovat skutečnost, že ačkoliv mnozí američtí prezidenti měli tento systém ve své agendě, teprve Obama byl první prezident schopný jej uzákonit. První část představuje popis aktérů legislativního procesu a jejich vzájemných vztahů. Druhá se věnuje popisu základní argumentaci využívané v debatách o této problematice, především americkému individualismu, úrovni federálního uspořádání a ústavní kultuře. Následující část se pak zabývá pokusmi o vytvoření univerzálního zdravotního systému v USA od jeho počátku až do Obamova „The Patient Protection and Affordable Care Act“, přičemž účelem je poukázat na tehdejší silný vliv opozice. Důraz je kladen na ideologické a kulturní důvody, které během minulého století činily a stále činí téma tak kontroverzní i po zavedení tohto zákona. Problematika je analyzována z kulturního a historického pohledu stejně jako v kontextu amerického legislativního systému a jeho tradic. Výsledkem této bakalářské práce je pak analýza legislativního procesu spojená s „The Patient Protection and Affordable Care Act“ z roku 2010 týkající se otázky, proč byl Obama prvním prezidentem americké historie, jež v této záležitosti uspěl. Jako jedny z hlavních důvodů jsou identifikovány především podpora Americké zdravotnické asociace (The American Medical Association), silného demokratického Kongresu, Obamovy ochoty vyjednávat s opozicí a finanční krize roku 2008, která způsobila, že velká skupina amerických občanů ztratila své zdravotní pojištění vplyvem ztráty zaměstnání.

Abstract:

The main purpose of the thesis is to introduce the reader the topic of health care in the United States and the efforts to enact a universal health care system on the federal level in the country. The thesis presents the fact that even though the many American Presidents had the universal health care system on their agenda, Obama was the first President who was able to enact it. Firstly, the actors of the legislation process and the relations between them are described. In the following chapter, the basic argumentation behind the health care debate, such as the American individualism, the strong federalism and the American constitutional culture, is presented. Then, the attempts to establish a universal healthcare system in the United States since their beginning until Obama's Patient Protection and Affordable Care Act are mentioned to give the reader an overview of how strong the opposition at those times was. Emphasis is put on the ideological and cultural reasons why the topic has been so controversial over the past century and continues to be, even after the enactment of the Patient Protection and Affordable Care Act. The outcome of the thesis is an analysis of the legislation process connected with the Patient Protection and Affordable Care Act of 2010 concerning the question why was Obama the first president in the American History who succeeded in this issue. As the main reasons are identified the support of American Medical Association, strong Democratic Congress, Obama’s willingness to negotiate with the opposition and the financial crisis of 2008 which caused that a large group of American citizens lost their health insurance due to unemployment.
