Structure and function of verbo-nominal structures in the selected German legal texts

Abstract:

The topic of the this bachelor thesis concerns the structure and function of the function of the verbo-nominal structures in two German legal codes - the penal code and the commercial code. The aim of this bachelor thesis is to characterize the structure and function of the concrete examples of verbo-nominal structures in the German Penal and Commercial Code. The bachelor thesis is divided into two parts - the theoretical and the practical one. In the theoretical part are at first explained the general grammatical and functional features of these verbo-nominal structures and then the linguistic and functional characteristics of the technical language and its subordinate legal language are described. The theory is supplemented by concrete examples from the legal field, which increase the clarity of the theoretical explanations. In the practical part are analysed thirty selected examples of the verbo-nominal structures, which were found in the two German law books by the author. These verbo-nominal structures have a different structure and meaning. But what all the examples have in common is f.e. the support of the nominal style and the compressed sentence structure. All these functions of the verbo-nominal structures in the legal language can contribute to the optimal legal communication, which is characterised by the highest possible clarity and accuracy in order to meet the communication needs in this area optimally.

Abstract:

Předkládaná bakalářská práce se zabývá strukturou a funkcí verbonominálních vazeb ve dvou vybraných německých zákonících - trestním zákoníku (Strafgesetzbuch) a obchodním zákoníku (Handelsgesetzbuch). Cílem práce je popsat strukturu a funkci verbonominálních vazeb v těchto zákonících. Práce se dělí na dvě části - teoretickou a praktickou. V teoretické části popisuje autorka gramatickou strukturu a funkci verbonominálních vazeb a následně se věnuje obecné charakteristice odborného stylu, pod který spadá i jazyk zákonů. Teorie je doplněna konkrétními příklady z oblasti práva, které přispívají k názornosti teoretických závěrů. V praktické části je analyzováno třicet verbonominálních vazeb, které se vyskytují v trestním a obchodním zákoníku Spolkové republiky Německo. Konkrétní verbonominální vazby mají různou strukturu a význam. Co mají však všechny příklady společného, je například to, že podporují nominální styl textů, slouží k opisu průběhového pasíva a přispívají ke zhuštěné výstavbě textu. Tyto funkce verbonominálních vazeb mohou být považovány za užitečný jazykový prostředek v oblasti právní komunikace. Řeč zákonů je totiž charakteristická svou jednoznačností a přesností, čímž přispívá k dosažení optimálního porozumění v právní komunikaci.
