The Rights of the Participant in the Administrative Proceedings with an Emphasis on the Abuse of these Rights

Abstract:

Diplomová práce je zaměřena na zneužívání práva a procesní obstrukce ze strany účastníků přestupkového řízení a jejich zmocněnců. Po teoretickém výkladu pojmů užívaných v praktické části byla provedena analýza vybraného rozhodování krajských soudů a Nejvyššího správního soudu o otázce zneužívání práva v oblasti přestupků v dopravě. Na základě poznatků získaných analýzou byly vyhodnoceny nejčastější způsoby zneužívání práva a nabídnut návod na postup správních orgánů při aplikaci institutu zneužití práva. Hlavním výsledkem práce je předložení návrhu opatření správních orgánů k eliminaci zneužívání práva a procesních obstrukcí.

Abstract:

The diploma thesis is focused on the abuse of law and procedural obstruction by partici-pants of the infringement procedure and their proxies. After a theoretical explanation of the terms used in the practical part, an analysis was carried out, concerning selected decisions of regional courts and the Supreme Administrative Court on the issue of the abuse of law in the field of traffic offences. Based on evidence of the analysis, the most common ways of the abuse of rights were evaluated and guidance on the procedure of the administrative authorities during the application of the abuse of law was offered. The main result of the thesis is presenting a proposal of provisions that administrative authorities can make to eliminate the abuse of rights and procedural obstructions.
