Administrative procedures in the field of offenses and other administrative offenses in transport

Abstract:

Bachelor thesis deals with the analysis of administrative law with an emphasis on administrative procedures in the field of offenses and other administrative offenses in transport. The aim of the thesis is to determine the most common administrative offenses and traffic offenses in relation to business. The first chapter presents the theoretical background for understanding the issue of the thesis. It contains definitions of administrative law, offense and the attributes of merits of offense for which were used primarily professional work of Slovak authors and legislation pertaining to this subject. The second chapter focuses on the status and progress of the administrative procedure in evidence and imposing sanctions. This chapter contains definitions of administrative procedure, administrative authorities and parties to the proceedings. The main part of this chapter is definition of offenses against the safety and flow of traffic and penalties for offenses and administrative offenses in transport. The third chapter analyzes the state administrative offenses and other offenses in the district of Banska Bystrica in relation to the business in the years 2009 to 2013.

Abstract:

Bakalárska práca sa zaoberá skúmaním správneho práva s dôrazom na správne konanie na úseku priestupkov a iných správnych deliktov v doprave. Cieľom bakalárskej práce je analýzou stanoviť najčastejšie správne delikty a priestupky v doprave vo vzťahu k podnikaniu. Prvá kapitola predstavuje teoretické východiská k pochopeniu danej problematiky. Obsahuje vymedzenie pojmov správne konanie, priestupok a znaky skutkovej podstaty priestupku. Pri tvorbe tejto kapitoly boli využité predovšetkým odborné práce slovenských autorov a legislatíva prislúchajúca tejto tematike. Druhá kapitola je zameraná na stav a priebeh správneho konania pri dokazovaní a ukladaní sankcií. Kapitola obsahuje definíciu pojmov správne konanie, správne orgány a účastníci konania. Dôraz kapitoly je kladený na proces dokazovania a ukladania sankcií, vymedzenie priestupkov proti bezpečnosti a plynulosti cestnej premávky a ukladanie sankcií za priestupky a správne delikty na úseku dopravy. Tretia kapitola analyzuje stav priestupkov a iných správnych deliktov v okrese Banská Bystrica vo vzťahu k podnikaniu v období rokov 2009 až 2013.
