Bans of Entry and Residence Imposed by Member States on Nationals of Other Member States of the European Union

Abstract:

Tato diplomová práce „Zákazy vstupu a pobytu uložené členskými státy občanům jiných členských států Evropské unie“ se zabývá tématem volného pohybu osob v rámci Evropské unie. Konkrétně práce zkoumá dovolená omezení svobodného pohybu občanů Unie, na jejichž základě členské státy přistupují k ukládání zákazů vstupu a pobytu občanům Unie. Práce vysvětluje, jak problematiku upravuje evropské právo (pro ilustraci přibližuje také vnitrostátní úpravu České republiky), jakých podob mohou výše zmíněné zákazy nabývat a uvádí praktické příklady vyhošťování ze strany Francie. Limity volného pohybu občanů Evropské unie jsou porovnány s možnostmi volného pohybu osob ze třetích zemí a problematika je zasazena do kontextu volného pohybu osob v rámci schengenského prostoru. Diplomová práce následně zkoumá adekvátnost přípustných omezení volného pohybu osob a věnuje se jejich hodnocení s ohledem na postupující evropskou integraci.

Abstract:

This thesis „Bans of Entry and Residence Imposed by Member States on Nationals of Other Member States of the European Union“ deals with the free movement of persons within the framework of the European Union. More specifically, this paper examines permissible restrictions of the free movement of the citizens of the European Union, which justify the impositions of the bans of entry and residence on the nationals of other member states of the European Union. This thesis focuses on how the problematic is regulated by the European law (also it presents current intranational legal regulation of the Czech Republic), how exactly are the bans of entry and residence materialized and it explains the practical examples of the bans of entry and residence imposed by France. Limits of the free movement of the citizens of the European Union are compared with those of the nationals of other countries. This problematic is viewed from the perspective of the free movement of persons within the Schengen Area. This thesis consequentially analyses the adequacy of the permissible restrictions of the free movement of persons and it evaluates their importance relatively to the process of European integration.
