Suggestions for changes in legal regulations of court fees in the Czech Republic

Abstract:

Práce obsahuje teoretickou a praktickou část vztahující se k problematice soudních poplat-ků. Zabývá se významem a funkcí soudních poplatků, poté právními prameny a historic-kým vývojem soudních poplatků v České republice. Závěr teoretické části přibližuje právní úpravu soudních poplatků ve vybraných zemích Evropské unie. Praktická část analyzuje samotný zákona č. 549/1991 Sb., o soudních poplatcích, ve znění pozdějších předpisů, s vysvětlením jednotlivých pojmů zákona, dále stručně analyzuje přílohu zákona č. 549/1991 Sb., o soudních poplatcích, kterou je sazebník soudních poplatků. Práce uvádí i alternativní druhy řízení k řízení soudnímu. V další části jsou pak samotné náměty změn pro právní úpravu soudních poplatků v České republice de lege ferenda. Nejprve to jsou náměty v oblasti výběru a příjmů ze soudních poplatků, a poté v oblasti související s vymáháním soudních poplatků. Samotný závěr praktické části popisuje správu soudních poplatků a ekonomické aspekty, a to i ve vztahu k navrhovaným opatřením. Práce obsahuje také něko-lik tabulek a grafů.

Abstract:

The thesis includes theoretical and practical parts relating to court fees area. It is about im-portance and function of court fees, then about sources of the law and historical develop-ment of court fees in the Czech Republic. The end of the theoretical part elucidates legal regulations of the court fees in chosen countries of the European Union. The practical part analyses directly law No. 549/1991 Digest, about court fees, as amended by later acts, with concept definition of law, then shortly analyses schedule of law No. 549/1991 Digest, about court fees, that is tariff of court fees. The thesis features also some alternative types of process to a court process. In the next part there are suggestions for changes in legal re-gulations of court fees in the Czech Republic de lege ferenda. Firstly there are suggestions in an area of drawings and court fees revenue, and then in an area associated with exacting of court fees. The end of practical part describs to administration of court fees and econo-mic aspects, namely in relation to proposed measures. The thesis includes also some tables and graphs.
