Remedial Measures in Administrative Procedure

Abstract:

Cílem této diplomové práce je shrnout a popsat soubor právních institutů opravných prostředků, které jsou uplatnitelné subjekty správně-právních vztahů. Zákonné ukotvení těchto procesních nástrojů je obsaženo v zákoně č. 500/2004 Sb., správního řádu, ve znění pozdějších předpisů. Tento právní předpis obsahuje řadu opravných prostředků, z nichž každý má své rozdílné uplatnění.Odlišují se od sebe zejména skutečností, zda směřují pravomocným či nepravomocným rozhodnutím. Dle právní moci rozhodnutí se opravné prostředky dělí na dvě základní kategorie. V prvé řadě jsou to řádné opravné prostředky, kterých bývá užíváno v daleko větší míře, druhou kategorií jsou prostředky a mimořádné, které se užívají v konkrétněji vymezených případech a obecně v menší míře. Opravné prostředky nejsou jedinými právními nástroji, které jsou správním řádem dány účastníkům řízení k dispozici. Správní řád upravuje více možností, jak dát najevo svou nespokojenost s výsledkem řízení příslušnému úřadu. V této práci se snažím popsat všechny ty právní prostředky, které mohou dle mého názoru mít význam ve správním řízení. Opravné prostředky jsou však hlavním tématem. Práce se skládá z 9 kapitol (tedy bez úvodu a závěru). První část obecně popisuje oblast vztahů, kde mohou být opravné prostředky dle správního řádu obecně využity, tedy oblast veřejné správy. Druhá část obsahuje krátké zamyšlení nad zárukami zákonnosti ve veřejné správě a místem opravných prostředků v tomto komplexu. Další kapitola se zabývá principy ve správním řízení, které dle mého názoru výrazně ovlivňují podobu těchto administrativně-správních postupů. Čtvrtá část je věnována definici pojmu opravného prostředku, rozřazení jednotlivých typů do kategorií a také vadami, které mohou být důvodem pro podání opravného prostředku. Pátá a zároveň nejdelší kapitola je věnována řádným opravným prostředkům, konkrétně odvolání, rozkladu a institutu odporu proti příkazu. Šestá část obsahuje popis mimořádných opravných prostředků, které hraničí spíše s dozorčími prostředky nápravy. Následující část shrnuje ostatní prostředky, které nabízí správní řád a jejich účel se více či méně blíží institutům opravných prostředků. Osmá kapitola popisuje vazby užití opravných prostředků na různé formy soudnictví, které jsou účastníkům k dispozici, konkrétně správní soudnictví, obecné soudnictví a ústavní soudnictví. Devátá a poslední část vlastní stati je věnována přeshraničním vlivům a jejich dopadům na podobu opravných řízení. Do práce se snažím začlenit maximální množství vlastních myšlenek a postřehů, přičemž jsem často postupoval metodou komparace různých myšlenek odborných autorů. V hlavní části pracuji zejména s komentáři ke správnímu řádu (zejména od R. Ondruše, J. Vedrala a kolektivu autorů Jemelka, Pondělíčková a Bohadlo), kde jsem se snažil vybrat ty názory, které z mého úhlu pohledu nejlépe vystihují danou problematiku. Závěr mé práce pak obsahuje vlastní názor na současný stav právní úpravy opravných prostředků a též návrhy, jak zmíněné nedostatky správního řádu řešit.

Abstract:

The aim of this diploma thesis is to summarize and describe institutes of legal remedies, available to subjects participating in administrative relations. The legal basis of these procedural instruments can be found in Act No. 500/2004 Coll., on Administrative Procedure as amended. This legal enactment includes several remedies, each specifically used in certain situations, especially defined by the fact, whether the decision is final or not. This legal effect divides legal remedies into two main groups. Firstly and more importantly for this thesis, the ordinary legal remedies, which are far more common in application, and secondly the special legal remedies, which can be applied in more specific situations and generally in fewer cases. But these institutes are not the only ones which are accessible to a person trying to get a different result in the proceedings. The Act No. 500/2004 Coll., especially in conjunction with Act No. 150/2002 Coll., offers more options how to bring a complaint in many different forms to relevant body. This thesis aims to basically describe (or in some places just summarize) all of those I thought important or useful. But of course, the legal remedies are still the main topic of this work. The work itself consists of nine chapters (not counting the introduction and conclusion). The first part generally describes the sphere, where these legal remedies can be applied, known as public administration. The second part contains a short thought over the the guarantees of legality in public administration and the place of legal remedies inside of this system. Next chapter deals with selected principles of administrative procedures, which in my opinion greatly influence the form of administrative proceedings. The fourth part aims to define the term of legal remedy, structures legal remedies into several categories and describes failures of administrative agencies, upon which the legal remedies can be applied. The fifth and longest chapter describes the three basic ordinary legal remedies. The most basic and used is the institute of appeal, then its specific case applied againist finding of certain central administrative agencies, and last is the institute of protestaion. The sixth chapter contains description of two cases of special legal remedies, used in certain cases either by participants of the proceedings or the legal agency itself. Another chapter sums up institutes with simillar uses like legal remedies, which can not be considered a part of this category. Eight part describes ties of legal remedies and administrative proceedings to the activities of different kinds of courts. These are administrative courts, civil courts and and the Constitutional court of the Czech Republic. Ninth and also last part deals with different kinds of international influence and its impact on the form of remedial proceedings. That means especially european principles of good administration and also activities of the European Court of Human Rights, based upon the European Convention on Human Rights from 1950. This thesis aims to contain many original thoughts and definitions, supported by legal opinions of selected literature authors. The main part, which describes particular institutes is conceived as a comparation of different points of view of different authors (mostly commentaries by R. Ondruš, J. Vedral and composite authors L. Jemelka, K. Pondělíčková and D. Bohadlo), from which I try to choose those I find to best describe existing matters. The conclusion of this work contains the my opinion on the current state of regulation of legal remedies and offers several ways of solutions of some of the gravest problems I found in the legal regulation contained in Act No. 500/2004 Coll., on Administrative Procedure.
