The Code of Administrative Procedure Relation to the Social Services Act ( Maintanance Contribution)

Abstract:

Téma bakalářské práce:„Působnost správního řádu ve vztahu k zákonu o sociálních službách (oblast příspěvku na péči)“ přibližuje čtenářům problematiku uplatňování procesních režimů veřejné správy v této oblasti. V úvodu práce jsou stručně vymezeny pojmy související s obecnou právní úpravou správního práva procesního, tak právní úprava daného úseku sociálních služeb, konkrétně u příspěvku na péči. Jádro bakalářské práce tvoří přiblížení průběhu správního řízení o příspěvku na péči kde se postupuje dle zákona č. 500/2004 Sb., správní řád, ve znění pozdějších předpisů, od zahájení řízení, problematiku sociálního šetření až po vydání rozhodnutí a zákona č. 108/2006 Sb., o sociálních službách, ve znění pozdějších předpisů, který stanoví některé odchylky od ustanovení správního řádu. Jsou zde uvedeny poznatky z praxe i relevantní judikatura. Závěr práce tvoří vlastní názor na problémy, které vnikají v této oblasti veřejné správy.

Abstract:

The theme of my bachelor thesis „The Code of Administrative Procedure relation to the Social Services Act (maintanance contribution)“ approaches the problem of the application of the procedural arrangements of public administration in this area. The introduction briefly defines terms related to the general lawful form of administrative procedural law and to the lawful form of the department of social services, specifically in the care allowance. The essential point of my thesis consists of administrative proceedings for the care allowance, which is proceeding in accordance with Act No.500/2004 of the Collection, Administrative Procedure, in the terms of later rules, from initiation, through the issue of social investigation to the decision, and Act No. 108/2006 of the Collection on Social Services, in the terms of later rules, which states certain exceptions from the arrangments of the Administrative Code. They are given samples from practice and relevant case law. The conclusion of my thesis is completed with my own opinion on the problems that arise in the field of the public administration.
