Diversions in the Czech Criminal Proceedings

Abstract:

Tématem mé bakalářské práce byly odklony v českém trestním řízení z pohledu restorativní justice. Princip restorativní (obnovující) justice se začal rozvíjet v první polovině 80. let 20. století nejprve v Kanadě a USA a postupně začal pronikat i do zemí Západní Evropy. Do českého trestního práva byly prvky restorativní justice zavedeny novelou trestního řádu č. 292/1993 Sb., v podobě nových institutů a to podmíněného zastavení trestního stíhání a narovnání (1995). Novelou trestního řádu z roku 2000 byl v trestním řádu zakotven institut zkráceného přípravného řízení, který taktéž obsahuje prvek restorativní justice a to v podobě podmíněného odložení návrhu na potrestání. Schválením a zavedením do praxe nového zákona o soudnictví ve věcech mládeže z. č. 218/2003 Sb., který nabyl účinnosti dnem 1.1. 2004 přibyl k těmto institutům další prvek a to odstoupení od stíhání mladistvého. Všechny zmiňované instituty si bezesporu našly své pevné místo v našem trestním řádu. Princip restorativní justice je jedním ze stále se rozvíjejících principů spravedlnosti a to nejen u nás, ale i v mezinárodním právu. První části své práce jsem se zaměřila na výklad základních pojmů trestního řízení a stručně jsem nastínila stádia klasického trestního řízení, abych na toto mohla v druhé části navázat a pomocí srovnání popsat jednotlivé odklony, vysvětlit jejich účel, smysl, význam a přínos jednotlivých odklonů trestního řízení z pohledu restorativní justice. Jak již ze samotného názvu vyplývá, hlavním účelem restorativní justice je obnova a to zejména obnova narušeného vztahu mezi poškozeným a pachatelem trestného činu. Důležitou institucí, která velkou měrou přispívá k aplikaci odklonů v praxi je Probační a mediační služba ČR, proto jsem jí ve své práci věnovala náležitý prostor. Svou práci jsem se pokusila zpracovat tak, aby byla srozumitelná právě pro tuto skupinu osob, tedy poškozených a pachatelů. Proto jsem se snažila spíše o laický výklad, bez používání odborných termínů. V závěru své práce jsem uvedla některé své úvahy týkající se odklonů v trestním řízení, které by mohly přispět ke zlepšení v této oblasti. Na úplný závěr chci uvést, že studium a zpracování této problematiky pro mě bylo velice zajímavé a vzhledem k mému povolání policistky v mnohém přínosné.

Abstract:

The subject of my bachelor thesis was: The diversions in the Czech criminal proceedings from the view of the restorative justice. The principle of the restorative justice started developing in Canada and in the USA in the early 80s of the 20th century; it later penetrated into the Western European countries, too. The Czech criminal law applied the first elements of the restorative justice in the form of new institutes, namely the conditional suspension of prosecution and settlement, in an amendment of the Criminal Law no. 292/1993 Coll. The Criminal Law Amendment in 2000 introduced the institute of a simplified preliminary procedure, which also contains an element of restorative justice in the form of a conditional postponement of punishment. The new Act No.218/2003 Coll., on judicial system in criminal cases of juvenile delinquents, which came into force on the 1st January 2004, added another element, namely an abandonment of a prosecution of a juvenile delinquent. All mentioned institutes have their stable place in our criminal law today. The restorative justice principle is one of the most developing principles of justice not only in the Czech Republic, but also within the international law. In the first part of my bachelor thesis I focused on the explanation of the fundamental concepts of the criminal proceedings and I briefly outlined stages of a typical criminal proceeding. In the second part I followed up with a comparison of individual diversions of criminal proceedings, explaining their purpose, meaning, reason and their contribution in terms of the restorative justice. As the name itself already implies, the main purpose of the restorative justice is the restoration, namely the restoration of an impaired relationship between the crime victim and the crime offender. I also paid special attention to the Probation and Mediation Service of the Czech Republic, which is an important institution, which largely contributes to the application of the diversions in practice. My aim was to elaborate this thesis in such a way, which especially this group, i.e. the victims and the offenders could understand. Hence my rather lay presentation without any technical formulations. At the close of my work I brought out some of my reflections regarding diversions in criminal proceedings, which could contribute toward an improvement in this field. I would like to stress that I found this issue through the studying and elaborating very important and very beneficial to my current job as a policewoman.
