Executory title

Abstract:

V této bakalářské práci je postupně popsán proces exekučního řízení. Práce nejprve vystihuje stručný exkurz do historie exekuce, následně její právní úpravu a předpoklady nařízení. Největší část práce je zaměřena na exekuční tituly, které jsou popsané v samostatné kapitole, po které následuje právní moc a vykonavatelnost. Poslední část práce řeší statistické údaje počtu exekucí a popisuje činnost soudního exekutora v praxi. Jsou zde také konkrétní příklady poukazující na mezery v zákoně č. 120/2001 Sb., které ztěžují exekutorům jejich úspěšné vymáhání práv.

Abstract:

In this bachelor thesis there is gradually described the process of execution proceedings. Firstly the thesis captures brief excursion into execution history and subsequently its legal adaptation and assumptions of regulation. The biggest part of the thesis is focused on executory titles, which are described in a separate section followed by legal power and enforceability. The last part of the thesis deals with statistics of executions and describes executor activity in practice. There are also specific examples pointing at gaps of Act No. 120/2001 Coll. which complicate executors successful law-enforcement.
