The Offence in the View of Rape in Juristic and Criminology Terms

Abstract:

Tato práce má název Trestný čin znásilnění z hlediska juristického a kriminologického. V juristické části, která je rozdělena na tři hlavní kapitoly, se nejdříve vracím do nedávné historie trestného činu znásilnění. Od roku 1961 do současné doby se v zákoně vystřídaly tři právní úpravy. Současnou právní úpravu trestného činu znásilnění podle § 185 následně podrobně rozebírám. Ve druhé kapitole jsem srovnávala trestný čin znásilnění s novým trestným činem sexuální nátlak a s trestným činem pohlavní zneužívání. Všechny tři trestné činy spadají do skupinu trestných činů proti lidské důstojnosti v sexuální oblasti a v některých ohledech se vzájemně prolínají. Ve třetí kapitole jsem nastínila německou právní úpravu trestného činu znásilnění a popsala některé hlavní rozdíly oproti české právní úpravě. Čtvrtá až šestá kapitola spadá do kriminologické oblasti. Ve čtvrté kapitole s názvem „Oběť trestného činu znásilnění“ jsem se zaměřila na proces viktimizace a postavení oběti v trestním řízení. Chtěla jsem především upozornit na některá problémy, se kterými se oběti znásilnění po oznámení trestného činu potýkají. V páté kapitole se krátce zabývám osobností pachatele znásilnění, jeho motivem a příčinami kriminálního chování a nakonec i prevencí. V šesté kapitole popisuji znásilnění v rámci mravnostních trestných činů z pohledu nejnovějších statistických dat. V poslední kapitole s názvem „ Závěrečné shrnutí a úvahy de lege ferenda“ se zamýšlím nad vymezením trestného činu znásilnění v zákoně a nad tím, jak by se dalo lépe chránit oběť trestného činu před sekundární viktimizací.

Abstract:

The name of this paper is criminal offence of rape in terms of Juristic and kriminology. In juristic part, which is divided in to three main chapters, first of all, I go back to the recent history of rape crimes. From 1961 to the present, three legislation amendments have been taken place in the Crime Code. Subsequently I analyse in detail the current legislation amendment of criminal offences of rape according to paragraph 185. In the second chapter, I confronted rape crime with the new crime offence of sexual harassment and with the crime of sexual abuse. All three crime offences are included in the group of criminal offences against human dignity in sexual sphere and in some regards they blend together. In the third chapter, I outlined the German legislation amendment of rape crime and inscribed some of the main differences compared to the Czech legislation amendment.The forth and the sixth chapter fall into the criminological sphere. In the forth chapter, which has the title, „Victim of rape crime“, I concentrate on the process of victimization and the role of victim in the criminal procedures. Primarily I wanted to draw attention to some of the obstacles, with which the victim fumble with after reporting to the police. In the fifth chapter, shortly I deal with the personality of rapist, his motivation and reasons of crime behavior and in the last but not least, about prevention. In the sixth chapter, I give an account of rape in terms of moral crimes according to the most recent statistical data. In the last chapter,“ Summary and reflection on de lege ferenda“, I consider how to define rape crime in the Crime Code and what must be done to protect victims of crimes against secondary victimization.
