Abstract:
Tato diplomová práce se zabývá problematikou smluvních typů upravující práva a povinnosti k softwaru a s nimi související aspekty. Vybranými dohodami jsou především smlouva o dílo a SaaS smlouva. Práce uvedené smlouvy rozebere v souvislosti s aktuální právní úpravou, analyzuje jejich obligatorní a fakultativní náležitosti a poskytne různá doporučení, jak koncipovat některé smluvní ujednání. This thesis deals with the issue of contract types governing rights and obligations to software and related aspects. The selected agreements are mainly contract for work and the SaaS subscription. The thesis analyses these contracts in the context of the current legislation, analyses their obligatory and optional elements and provides various recommendations on how to draft certain contractual arrangements …more
