Abstract:

Práce se zabývá patentovatelností počítačových programů. Zahrnuje analýzu patentovatelnosti počítačem uskutečněných vynálezů dle Evropské patentové úmluvy a analýzu patentovatelnosti počítačových programů dle patentového práva Spojených států amerických. Výsledky analýzy jsou následně porovnány za účelem nalezení shodných, podobných a odlišných znaků. V důsledku této komparace práce dospívá k závěru o částečné kvazi-unifikaci porovnávaných oblastí práva. Práce také obsahuje návrhy změn de lege ferenda, pokud jde o patentovatelnost počítačem uskutečněných vynálezů a počítačových programů.

Abstract:

The thesis deals with the patentability of computer programs. It contains an analysis of the patentability of computer-implemented inventions under the European Patent Convention and an analysis of the patentability of computer programs pursuant to the patent law of the United States of America. The results of the analysis are subsequently compared with a view to identifying identical, similar, and different features. As a result of this comparison, the thesis arrives at the conclusion of a partial quasi-unification of the compared areas of law. The thesis also proposes changes de lege feranda in terms of the patentability of computer-implemented inventions and computer programs.
