Business Secret in the business

Abstract:

The aim of this work is to express the definition and funcioning of the trade secret in the business. The main source we have used was Code de commerce, in which the trade secret is defined in individual provisonos. The aim of this work is to express the main conceptual attributes, the alternatives of disposal and legal protection of the trade sectret of the business. We defined the alternative of protection of trade secret in industrial relations by integration into contract of employment and the alternative of anction in case of defiance of trade secret. We defined risks and threat of trade secret for example by unfair competition. We focused on criminal protection of trade secret accord to Code penal. We have shown on existence other sorts of secrets, which are also close to the trade secret in the way of meaning, for example know – how, intellectual property and bank secret. We compare them with the trade secret and post secret.

Abstract:

Zámerom tejto práce je vyjadrenie a využitie obchodného tajomstva pri podnikaní. Hlavným prameňom, ktorý sme použili pri spracovaní témy bol Obchodný zákonník, v ktorom je obchodné tajomstvo vymedzené. Práca vyjadruje základné pojmové znaky obchodného tajomstva, možnosti disponovania s obchodným tajomstvom a jeho právnu ochranu pri podnikaní. Uviedli sme ako chrániť obchodné tajomstvo v pracovnoprávnych vzťahoch včlenením do pracovných zmlúv a možné udelenie sankcie za porušenie obchodného tajomstva. Zadefinovali sme riziká a ohrozenie obchodného tajomstva nekalou súťažou. Zamerali sme sa na trestnoprávnu ochranu obchodného tajomstva podľa Trestného zákona. Poukázali sme na existenciu iných inštitútov, ktoré sú blízke obchodnému tajomstvu. S obchodným tajomstvom sme porovnali inštitúty know-how, bankové tajomstvo a poštové tajomstvo.
