The level of banking regulation in the United States of America

Abstract:

Diplomová práce se zabývá očekávaným zlomem v bankovní regulaci na území Spojených států amerických po nástupu Donalda Trumpa do prezidentského úřadu. Úvod obstarává pohled na hlavní historické události amerického bankovnictví, jejichž dopady mají vliv na obraz bankovní regulace v dnešní době. Druhá kapitola začíná popisem amerického bankovního trhu, a dále se věnuje vysvětlení fungování složitého duálního systému bankovní regulace včetně jeho institucionálního uspořádání. Práce pokračuje objasněním stávajících požadavků bankovní regulace vycházejících ze skloubení implementace mezinárodního doporučení Basel III a zákona Dodd Frank Act. V další kapitole jsou představeny deregulační zájmy Republikánské strany v podobě návrhu Financial CHOICE Act a již schváleného zákona s.2155. V závěrečné části probíhá diskuze tří hlavních rozporů mezi zastánci a odpůrci zákona Dodd-Frank. Konkrétně na téma stanovení optimální regulatorní zátěže, řešení problému "too big to fail" a odstranění Volckerova pravidla.

Abstract:

The diploma thesis focuses on an expected change in the direction of banking regulation in the United States, reflecting Donald Trump´s administration after his election. It begins with a review of periods in American banking history which have a significant impact on today’s form of banking regulation. The second chapter starts with the introduction of American banking market and then it explains the dual banking system specifics and describes its supervisory authorities. The following part includes current regulatory framework based on implementation of Basel III and the Dodd-Frank Act. After that, it talks about the Republican Party’s interest in regulatory relief represented by their Financial CHOICE Act proposal and an already enacted bill s.2155. The last part of the thesis discusses three important topics of banking regulation that have also been part of the conflict between supporters and opponents of Dodd-Frank Act repeal—optimal capital requirement, the "too big to fail" issue, Volcker rule.
