Development of Notion of Exceptions from Prohibition of Measures Having Equivalent Effect as Quantitative Restrictions

Abstract:

Tato diplomová práce se zabývá charakteristikou vývoje chápání opatření s rovnocenným účinkem jako množstevní omezení dovozu a vývozu, jako jednoho z omezení volného pohybu zboží mezi členskými státy Evropské unie, vývojem jejich pojetí, obsahu a rozsahu tohoto pojmu. Dále se tato práce věnuje charakteru zákazu uvedených opatření a dále povoleným výjimkám, jež jsou z tohoto zákazu vyjmuty v zájmu sledování ochrany hodnot převažujících nad volným pohybem zboží, a rovněž podmínkám, které je nutné pro ospravedlnění existence opatření s rovnocenným účinkem převažujícím zájmem dodržet. Zpracování dané problematiky vychází z čl. 34, 35 a 36 Smlouvy o fungování Evropské unie a opírá se především o judikaturu Soudního dvora Evropské unie.

Abstract:

This thesis characterizes the development of understanding of measures having equivalent effect to quantitative restrictions on imports and exports as one of the restrictions on the free movement of goods between the Member States of the European Union; development of concepts, content and scope of that term. Furthermore, this work is concerned with the nature of the prohibition of such measures and permitted exceptions, which are exempted from this prohibition in order to monitor the protection of the prevailing values of the free movement of goods, and also the conditions that are necessary to be observed to justify the existence of measures having equivalent effect by the overriding interests. Discussion of the issue concerned stems from the Articles 34, 35 and 36 of the Treaty on the Functioning of the European Union and it is based primarily on the case law of the Court of Justice of the European Union.
