The Legal Regulation of the International Trade between the EU and India

Abstract:

Anotace Diplomová práce „Právní úprava obchodu Evropské Unie s Indií“ se zabývá jak právním rámcem regulace společné obchodní politiky EU se zaměřením na úpravu celní unie, tak mezinárodněprávní bilaterální úpravou obchodních vztahů EU a Indie se zaměřením na dovoz z Indie do EU. Hlavním cílem práce je komplexní zpracování přehledu dosavadní úpravy obchodu EU a Indie. Práce je rozdělena do šesti kapitol. První dvě kapitoly teoreticky zachycují pravomoc EU v oblasti společné obchodní politiky, rámec její právní regulace a dále základní východiska celní unie EU. V rámci kapitoly o celní unii jsou popsána specifika úpravy týkající se dovozu zboží z Indie. Na teoretické kapitoly navazuje praktická část práce zabývající se mezinárodněprávní úpravou obchodu EU a Indie. Tuto část uvádí stručná analýza vývoje obchodního prostředí a ekonomiky Indie a vzájemného obchodu EU s Indií. Hlavními kapitolami praktické části jsou pak nástin vývoje obchodních vztahů EU a Indie a jejich právní úpravy od 60. let po současnost, zvláštní úprava některých oblastí SOP na základě tzv. bilaterálních sektorových dohod a dále analýza nadcházející Dohody o volném obchodu (FTA, Free Trade Agreement), jejíž podpis je očekáván na jaře roku 2011. Analýza FTA zahrnuje vývoj dosavadních jednání, nástin předpokládaného obsahu a zhodnocení možných ekonomických a sociálních dopadů vzniku zóny volného obchodu mezi EU a Indií.

Abstract:

Annotation The thesis “The Legal Regulation of the International Trade between the EU and India“ deals with the legal framework of the EU Common Commercial Policy, focusing on the regulation of the Customs Union, and the regulation of bilateral trade relations betwen the EU and India, focusing on imports from India to the EU. The main objective is to present a comprehensive overview of current trade regulation between the EU and India. The thesis is divided into six chapters. The first two chapters deal with the EU's Common Commercial Policy, its regulatory framework and the Customs Union, including special regulations regarding the custom procedure imposed on imports from India. Following chapters deal with the regulation of trade relations betwen the EU and India. This part is prefaced by a brief analysis of the development of the business environment and economy of India and the bilateral trade between India and the EU. Main chapters are as follows: development of trade relations between the EU and India from the 60`s up to this day, special regulation of certain aspects of the Common Commercial Policy through bilateral agreements and the analysis of the upcoming Free Trade Agreement (FTA). The FTA is about to be signed in spring 2011. The analysis of the FTA includes development of current negotiations, outline of its contents and the evaluation of potential economic and social impacts of the FTA between the EU and India.
