The Role of a Public Guardian in Relation to the Providers of Social Services

Abstract:

Diplomová práce se věnuje hodnocení praxe veřejného opatrovnictví, které vykonávají obce osobám s omezenou svéprávnosti (výjimečně bez omezené svéprávnosti) a to ve vztahu k poskytovatelům sociálních služeb. V teoretické části budou uvedeny informace týkající se otázky svéprávnosti, jejího omezení, alternativ k tomuto institutu, dále pak k podmínkám ustanovení veřejného opatrovníka, povinnostem veřejného opatrovníka obecně, ale i ve vztahu k poskytovatelům sociálních služeb. Ve výzkumné části budou prezentovány výsledky výzkumu, jenž je zpracován kvalitativní strategií výzkumu. Výzkumný soubor představují osoby vykonávající osobně, nebo v pověření statutárním orgánem, funkci veřejného opatrovníka a s problematikou se pravidelně setkávají. Data budou získávána metodou dotazování a technikou polostrukturovaných rozhovorů. V závěru práce budou představeny nejproblematičtější otázky z praxe veřejných opatrovníků ve vztahu k poskytovatelům sociálních služeb.

Abstract:

The diploma thesis deals with the evaluation of the public guardianship in practice, which is being provided by municipalities to persons with limited legal capacity (exceptionally without limited legal capacity) in relation to the providers of social services. The theoretical part provides data about the question of legal capacity and its restrictions and alternatives. Furthermore, it depicts the conditions of a public guardian assignment, the duties of a public guardian in general and also in relation to the providers of social services. The research part presents the outcome of the qualitative research, which is applied in this thesis. The field of study is represented by persons who are performing either personally or with statutorial authorization the function of a public guardian and are therefore in regular touch with the issue. The data are collected by the questioning method and the technique of semi-structured interviews. The most problematic areas of the public guardian practice in relation to the providers of social services are presented in the conclusion of this thesis.
